1. Scope of Application
1.1 These General Terms and Conditions apply to all contracts concluded between a customer and Taberhofer GmbH (hereinafter “Provider”) regarding ski rental, ski school, ski service, or other services in these areas.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person who, when entering into a legal transaction, acts in exercise of their trade, business, or profession.
1.3 These GTC apply in their current version. Any terms of the customer deviating from these GTC shall not be recognized unless the Provider expressly agrees to their validity in writing.
2. Conclusion of Contract / Reservation
2.1 Offers made by the Provider are non-binding unless expressly designated as binding.
2.2 A contract is concluded upon acceptance of the offer by the Provider, e.g., by written or electronic confirmation of the reservation, or by handing over the rental equipment or commencement of the service.
2.3 For reservations, the customer is requested to provide all relevant information completely and correctly (e.g., regarding equipment, height/weight/shoe size, skill level, health restrictions) so that the Provider can deliver appropriate services and equipment.
3. Prices & Payment
3.1 All prices are quoted in euros and include statutory VAT unless otherwise stated.
3.2 Payments must be made exclusively on site. Customers may pay in cash or by card.
3.3 In the event of late payment, statutory default interest shall apply. The Provider reserves the right to charge reminder and collection fees to the customer.
4. Ski School Services
4.1 The ski school offers courses and private lessons in snow sports. Course types, skill levels, age groups, etc., are described in the respective offers.
4.2 Group allocation is based on age, skill level, pedagogical, and safety-related considerations.
4.3 Lessons not attended (e.g., due to non-appearance) will generally not be refunded.
4.4 The Provider reserves the right to make changes to course schedules (e.g., due to weather, snow conditions, or safety reasons). Customers will be informed as early as possible.
5. Ski Rental & Ski Service
5.1 Rental equipment is handed over in proper technical condition. The customer must inspect for any visible defects upon receipt and immediately notify the Provider.
5.2 The customer is liable for loss, theft, and severe damage to rental equipment, unless covered by insurance.
5.3 Return times and rental periods must be observed. Late returns may incur additional fees (e.g., daily rental charges).
5.4 Early return of rental equipment does not automatically entitle the customer to a refund of unused rental days, except in cases of illness or accident with an appropriate medical certificate, or if otherwise agreed.
6. Withdrawal / Cancellation / Postponement
6.1 The customer may withdraw free of charge up to a certain time before the start of the service; after this point, cancellation fees may apply. Specific deadlines are stated in each service or offer.
6.2 For courses/lessons, staggered cancellation conditions apply (e.g., percentage rates depending on the cancellation period).
6.3 Similar rules apply for rental equipment; see section 5 regarding early returns.
6.4 In cases of illness or accident with a medical certificate, a refund or credit may be granted in certain cases.
6.5 In cases of force majeure or unforeseen circumstances beyond the Provider’s control, the Provider may postpone, reduce, or cancel services. Refunds will only be granted for services not provided.
7. Liability
7.1 The Provider is liable for damages arising from injury to life, body, or health in accordance with statutory provisions, particularly in cases of intentional or grossly negligent breach of duty.
7.2 For other damages, the Provider is liable only in cases of intent or gross negligence.
7.3 The customer is obliged to report any damages or defects immediately upon discovery.
7.4 The Provider shall not be liable for damages resulting from the customer’s failure to follow safety instructions, official regulations, or user guidelines.
8. Data Protection
8.1 Personal data is collected and processed for the purpose of fulfilling the contract, handling transactions, and communication.
8.2 The applicable legal data protection provisions (e.g., GDPR) apply.
8.3 Further information can be found in the Provider’s privacy policy.
9. Place of Jurisdiction, Place of Performance, Miscellaneous
9.1 The place of performance for all services and payments is the Provider’s business location, insofar as legally permissible.
9.2 The place of jurisdiction is, insofar as legally permissible, the Provider’s registered office.
9.3 If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall not be affected. The invalid clause shall be replaced by a valid provision that comes closest to the intended economic purpose.
9.4 Changes or additions to the contract must be made in writing unless a different form is required by law.
